1. Overview

Welcome to this website (the “Site”), which is owned by GoSites. These Terms of Service establish the terms and conditions for your use of this Site and the products and services (individually and collectively, the “Services”) found on this Site.

The terms “we,” “us,” or “our” will refer to GoSites. The terms “you,” “your,” “User,” or “customer” will refer to any individual or entity that accepts these Terms of Service by using this Site or the Services found on this Site.

Nothing in these Terms of Service shall be construed as granting rights or benefits to any third parties. GoSites, in its sole and absolute discretion, may change or modify these Terms of Service, and any policy or agreement incorporated herein, at any time, and such changes or modifications will become effective immediately upon posting on this Site.

You acknowledge and agree that (i) GoSites may notify you of such changes or modifications by posting them on this Site, and (ii) your use of this Site or the Services found on this Site after such changes or modifications have been made (as indicated by the “Last Revised” date at the top of this page) will constitute your acceptance of these Terms of Service in their most recent revision. If you do not accept to be bound by these Terms of Service in their most recent revision, do not use (or continue to use) this Site or the Services found on this Site.

2. Accepted Payment Options

We accept various forms of payment to facilitate your transactions, including PayPal, credit/debit cards (Visa, MasterCard, American Express), and bank transfers (as requested).

3. Card Acquisition and Security

Card transactions will be processed for GoSites through Stripe, LLC. Stripe, LLC will store and process payments made with bank cards. No card data is stored on the GoSites website. Users can visit www.stripe.com to review their privacy and security policy.

4. Delivery Policy

All orders will begin to be processed the same day and will be completed as specified in the times for each service. The processing times for hosting and domains should be automated upon payment.

5. Refund Policy

The provision of goods and services by GoSites is subject to availability. In the event of unavailability, GoSites will refund the customer the full amount within 30 days. The cancellation of orders by the customer will not incur any administrative fees. Refunds will not be issued after a period of 30 days. Domain registration is not a refund option; however, you may prevent its renewal if you no longer require the domain.

6. Eligibility and Authority

This Site and the Services contained therein are available only to Users who can enter into legally binding contracts under applicable law. By using this Site or the Services contained therein, you represent and warrant that (i) you are at least eighteen (18) years of age and/or (ii) otherwise have the capacity to enter into legally binding contracts under applicable law.

If you accept these Terms of Service on behalf of a corporate entity, you represent and warrant that you have the legal authority to bind that corporate entity to these Terms of Service, in which case the terms “you,” “your,” “user,” or “customer” will refer to that corporate entity. If, after your acceptance of these Terms of Service, GoSites discovers that you do not have the legal authority to bind that corporate entity, you will be personally responsible for the obligations contained in these Terms of Service. GoSites will not be liable for any loss or damage resulting from its reliance on any instruction, notice, document, or communication that GoSites reasonably believes is genuine and originated from an authorized representative of your corporate entity. If there is a reasonable doubt regarding the authenticity of such instruction, notice, document, or communication, GoSites reserves the right (but assumes no obligation) to request additional authentication.

7. Accounts

To access certain features of this Site or use some of the Services found on this Site, you must create an account (an “Account”). You represent and warrant to GoSites that all information you submit when creating your Account is accurate, current, and complete, and that you will maintain the accuracy, currency, and completeness of your Account information. If GoSites has reason to believe that your Account information is false, inaccurate, outdated, or incomplete, GoSites reserves the right, in its sole and absolute discretion, to suspend or terminate your Account. You are solely responsible for the activity that occurs in your Account, whether or not you authorized that activity, and you must keep your Account information secure, including, but not limited to, your customer/login number, password, and payment method(s).

8. Conduct Rules

You acknowledge and agree that:

• Your use of this Site and the Services found therein, including any content you submit, will comply with these Terms of Service and all applicable local, state, national, and international laws, rules, and regulations.
• You will not collect or harvest (or allow anyone else to collect or harvest) any User Content (as defined below) or any non-public or personally identifiable information about another User or any other person or entity without their express prior written consent.

You will not use this Site or the Services found on this Site in a manner (as determined by GoSites in its sole and absolute discretion) that:

• Is illegal or promotes or encourages illegal activity;
• Promotes, fosters, or engages in child pornography or the exploitation of children;
• Promotes, incites, or participates in terrorism, violence against persons, animals, or property;
• Promotes, encourages, or participates in any unsolicited bulk email or other mass unsolicited email or hacking or hacking of computers or networks;
• Violates the Ryan Haight Online Pharmacy Consumer Protection Act of 2008 or similar legislation, or promotes, encourages, or participates in the sale or distribution of prescription drugs without a valid prescription;
• Infringes the intellectual property rights of another User or any other person or entity;
• Violates the privacy or publicity rights of another User or any other person or entity, or breaches any confidentiality duty you owe to another User or any other person or entity;
• Interferes with the operation of this Site or the Services contained therein;
• Contains or installs viruses, worms, bugs, Trojan horses, or other codes, files, or programs designed to or capable of interrupting, damaging, or limiting the functionality of any software or hardware;
• You will not copy or distribute any part of this Site or the Services contained therein in any medium, except where expressly authorized by GoSites.
• You will not modify or alter any part of this Site or the Services contained therein or any of its related technologies.
• You will not access GoSites Content (as defined below) or User Content through any technology or means other than through this Site itself, or as GoSites may designate.
• You agree to back up all your User Content in order to access and use it when necessary. GoSites does not guarantee that it backs up any Account or User Content, and you accept the risk of losing all or part of your User Content.

9. Your Use of GoSites Content and User Content

In addition to the above general rules, the provisions of this Section 9 specifically apply to your use of GoSites Content and User Content posted on GoSites’ corporate websites (i.e., those sites that GoSites directly controls or maintains). The applicable provisions are not intended to transfer, nor do they have the effect of transferring, any ownership or license rights (including intellectual property rights) that you may have in the content published on your hosted websites.

Except for User Content, the content on this Site and the Services contained herein, including, but not limited to, text, software, scripts, source code, APIs, graphics, photographs, sounds, music, videos, interactive features, and trademarks, service marks, and logos located therein (“GoSites Content”), are the property of GoSites or are licensed to it in perpetuity, and are subject to copyright, trademark, and/or patent protection in the United States and foreign countries, and other intellectual property rights under the laws of the United States and foreign countries.

GoSites Content is provided to you “as is,” “as available,” and “with all faults” for your information and personal, non-commercial use only, and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any purpose without the prior written consent of GoSites. These Terms of Service do not grant any right or license under any copyright, trademark, patent, or other proprietary right or license. GoSites reserves all rights not expressly granted in and to the GoSites Content, this Site, and the Services contained herein, and these Terms of Service do not transfer ownership of any of those rights.

10. Account Cancellation Policy

Generally, GoSites does not pre-screen User Content (whether posted on a GoSites-hosted website or posted on this Site). However, GoSites reserves the right (but assumes no obligation) to do so and to determine whether any item of User Content is appropriate and/or complies with these Terms of Service. GoSites may remove any item of User Content (whether posted on a GoSites-hosted website or posted on this Site) and/or cancel a User’s access to this Site or the Services contained herein for posting or publishing any material that violates these Terms of Service, or for otherwise violating these Terms of Service (as determined by GoSites in its sole and absolute discretion), at any time and without prior notice.

GoSites may also cancel a User’s access to this Site or the Services contained herein if GoSites has reason to believe that the User is a repeat infringer. If GoSites cancels your access to this Site or the Services contained herein, GoSites may, in its sole and absolute discretion, delete and destroy any data and files that you have stored on its servers.

11. Reservation of Rights

GoSites expressly reserves the right to deny, cancel, terminate, suspend, block, or modify access to (or control of) any Account or Service (including the right to cancel or transfer any domain name registration) for any reason (as determined by GoSites in its sole and absolute discretion), including, but not limited to, the following: (i) correcting mistakes made by GoSites in providing or delivering any Service (including any domain name registration), (ii) protecting the integrity and stability of, and correcting mistakes made by, any domain name registration, (iii) assisting with our fraud and abuse detection and prevention efforts, (iv) complying with applicable local, state, national, and international laws, rules, and regulations, (v) complying with law enforcement requests, including subpoena requests, (vi) complying with any dispute resolution process, (vii) defending against any legal action or threat of legal action regardless of whether such legal action or threat of legal action is ultimately determined to have any merit, or (viii) avoiding any civil or criminal liability on the part of GoSites, its officers, directors, employees, and agents, as well as GoSites affiliates.

12. Trademark and/or Copyright Claims

GoSites follows a policy of compliance with applicable law and will respect the laws of the country in which the website data is located.

13. Compliance with Local Laws

GoSites makes no representations or warranties that the content available on this Site or the Services contained herein are appropriate in all countries or jurisdictions, and access to this Site or the Services contained herein from countries or jurisdictions where its content is illegal is prohibited. Users who choose to access this Site or the Services contained herein are responsible for complying with all local laws, rules, and regulations.

14. No Third-Party Beneficiaries

Nothing in these Terms of Service shall be construed as conferring rights or benefits on third parties.
